1. Introduction

Neocom - Distribuição Componentes Automóvel, Lda., within the scope of its commercial activity, needs to collect some personal data from its customers, however, it respects the right to privacy and does not collect any personal information without the prior consent of its customers.
Neocom's Privacy Policy serves to provide a clear understanding of how we collect, use, share and protect our customers' personal data when they use our services or visit our website.

3. Processing and modification

By providing your personal data to Neocom, the customer acknowledges and consents to the processing of said data in accordance with this Privacy Policy and the rules and principles set out in the respective terms and conditions of the services used. To this extent, and regarding the processing of personal data, the customer must read this Privacy Policy.
We inform you that, whenever deemed necessary, we will change this Privacy Policy without the need for any prior authorization.

 

4. What is personal data?

This is any information, of any nature and regardless of its support, relating to a natural person, directly or indirectly, identified or identifiable (data subject).

 

5. What personal data is collected and processed

The personal data collected by Neocom is limited to that strictly necessary for the purpose of the processing, namely, name, address, tax number, telephone number or email, but other data necessary for the provision of products or services may be collected.

 

6. When and for what purpose we collect personal data

The personal data we collect from our customers is requested when making a purchase or ordering products or services in our store or through our sales team.
Some personal data must be provided. Neocom will inform you of this obligation. Providing incorrect or inaccurate data is the sole responsibility of the customer who owns the data.
The collection and processing of personal data by Neocom has the following purposes: 1) Customer management, 2) Marketing and 3) Profiling, which we detail below:

  1. Customer Management: since Neocom is dedicated to the sale of car parts, the processing of your data is necessary for the fulfilment of the purchase and sale or service provision contract to be concluded or for carrying out pre-contractual steps at the customer's request, such as budgeting.
  2. Marketing or Telemarketing: Neocom may process the personal data collected to send the respective data subject information about products and services sold by it. This processing of personal data will only be carried out with the express consent of the data subject, when creating a customer file in store or when subscribing to our newsletter. If you consent, you will receive marketing communications via email, post, telephone and/or SMS. Consent for the processing of personal data for direct marketing purposes may be revoked at any time by the data subject. The personal data collected for this purpose will be kept for 2 years of inactivity.
  3. Profile definition: Neocom defines profiles based on information related to purchases made in our physical stores, recording the products purchased, amounts paid, date and time, as well as the place of purchase. The information collected is analysed to identify your consumption profile, allowing Neocom to improve its offer, plan its communication, and send personalized information suited to each customer's profile.

 

7. Sharing or transferring personal data

The personal data collected by Neocom is for the exclusive use of the company.
Neocom may use subcontractors for all or part of the purposes identified above, as well as for the maintenance, hosting and management of its computer systems and equipment, under the terms permitted by the legislation that regulates the processing of personal data, and these entities are obliged to maintain confidentiality and guarantee the security of the personal data to which they have access for this purpose, and must not use such data for any other purposes, or for their own benefit, nor relate it to other data they possess.
Personal data may also be made available to the courts and other competent authorities, in strict compliance with the provisions of the law.
Personal data collected by Neocom will be processed within the European Union.

 

8. Period of retention of personal data

Neocom retains personal data for the retention periods identified above and only for the period necessary, or for the fulfilment of obligations to which it is legally subject. In any case, once the relationship with the holders of personal data has ended, these data will no longer be processed for commercial purposes.

 

9. Security and confidentiality of personal data

Neocom is committed to implementing all necessary precautions to preserve the confidentiality and security of the personal data collected and processed, preventing them from being distorted, damaged, destroyed, or from being accessed by unauthorized third parties.
Technical and organizational security measures have been developed, especially about information systems. However, we do not control all risks related to the use of the Internet and we would like to warn you of the possible risks associated with its use and operation, and consequently, the sharing of personal data via this route.

 

10. Rights of the holder of personal data

In accordance with current legislation, the holder of personal data has the right to access and rectify their data, as well as the right to request its deletion, oppose its processing and obtain its limitation or portability to the extent applicable. They may also object to their data being used for the purpose of creating their customer profile, in which case they will no longer benefit from personalized offers or services.
The exercise of any of the rights legally conferred by the respective holder must be done by registered letter or email signed by the holder and accompanied by a photocopy of an identity document with the signature of the holder exercising his/her right.

The holder of personal data must be aware that, in certain cases (legal imperatives, for example), his/her request may not be immediately satisfied. In any case, he/she will be informed of the measures taken in this regard, within a maximum period of one month from the moment the request is made.
The holder of personal data may also withdraw his/her consent at any time, where applicable, through the channels made available for this purpose by Neocom. However, the withdrawal of consent does not compromise the lawfulness of the processing carried out based on the consent previously given nor the subsequent processing of the same data, based on another legal basis, such as compliance with the contract or legal obligation to which Neocom is subject.

As previously mentioned, Neocom collects and processes the personal data necessary for the provision and operation of its website, while ensuring adequate levels of security and protection of its users' personal data.
